The 7th Day<\/strong> These General Terms and Conditions apply to orders placed through the online shop of The 7th Day and, where expressly stated, to participation in the art project The 7th Day.<\/p>\n\n The provider is:<\/p>\n\n \nAtelier Zajfert<\/strong> \nEmail: post@the-7th-day.de A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their self-employed professional activity.<\/p>\n\n The provisions concerning participation in the art project, the submission or digital transmission of photographs and the associated rights of use also apply to persons who did not themselves purchase a participation set but submit or digitally transmit an image created with a camera from The 7th Day for participation in the project.<\/p>\n\n This requires that the participating person has been informed of these participation terms before submitting or transmitting the image and has had the opportunity to take note of them.<\/p>\n\n The presentation of products in the online shop does not constitute a binding offer to conclude a purchase contract.<\/p>\n\n By submitting the order, the customer makes a binding offer to purchase the goods contained in the shopping cart.<\/p>\n\n After the order has been received, the customer receives an automatic email confirming receipt of the order.<\/p>\n\n An email that merely confirms receipt of the order does not yet constitute acceptance of the customer’s offer.<\/p>\n\n The purchase contract is concluded as soon as The 7th Day expressly informs the customer by email that the order has been accepted or is being processed. If the automatically generated order email already expressly states that the order is being processed, this email also constitutes acceptance of the customer’s offer.<\/p>\n\n A payment confirmation issued solely by a payment service provider does not in itself constitute acceptance of the order.<\/p>\n\n After payment or processing of the order, the customer may receive further confirmations and the invoice by email. The specific photographic result depends in particular on the exposure time, lighting conditions, location, weather, orientation, positioning and handling of the camera.<\/p>\n\n A specific photographic, colour-related or artistic result is therefore not owed.<\/p>\n\n The absence of a specific image result does not in itself constitute a defect in the camera or participation set, provided that the delivered components have the agreed characteristics.<\/p>\n\n The customer’s statutory rights in the event of actually defective goods remain unaffected.<\/p>\n\n The purchase of a participation set does not oblige the purchaser to participate in the digital archive or to submit an image.<\/p>\n\n After the exposure, there are generally two options:<\/p>\n\n Participation is voluntary in both cases.<\/p>\n\n Only by submitting the exposed photographic paper or transmitting the independently digitised image does the participating person decide to take part in the art project The 7th Day in accordance with these participation terms.<\/p>\n\n A person who neither submits the photographic paper nor transmits a digital image to The 7th Day does not participate in the public digital archive with that image.<\/p>\n\n If the participating person is a minor, the necessary consent of their legal representative must be obtained for participation and for the granting of the associated rights of use.<\/p>\n\n If the exposed photographic paper is submitted to The 7th Day, the image created on it will be digitised and technically processed for presentation within the project.<\/p>\n\n Technical processing may in particular include scanning or photographing the negative, converting the negative into a positive image, adjusting the orientation and making customary adjustments to brightness, contrast and colour.<\/p>\n\n When the light-sensitive photographic paper is digitised, further exposure to light may fully expose the paper. As a result, the original analogue negative may be permanently altered or rendered unusable in its original form.<\/p>\n\n By submitting the photographic paper, the participating person expressly agrees to this technically necessary process.<\/p>\n\n There is therefore no entitlement to the return of the photographic paper in its original condition.<\/p>\n\n If the participating person chooses to carry out the digitisation independently, this alteration of the original will not be caused by The 7th Day. In this case, only the digital image submitted by the participating person will be further processed.<\/p>\n\n The submitted or digitally transmitted image will generally be published in the publicly accessible online archive of The 7th Day.<\/p>\n\n By submitting the photographic paper or transmitting the digital image, the participating person agrees to this publication in accordance with the provisions concerning rights of use set out below.<\/p>\n\n No additional approval is required after the photographic paper or digital image has been submitted.<\/p>\n\n Anyone who does not wish their image to be published in the digital archive should therefore neither submit the exposed photographic paper nor transmit a digital image to The 7th Day for publication.<\/p>\n\n The 7th Day reserves the right not to publish individual images or to remove them from the archive at a later date, particularly for legal, technical or content-related reasons.<\/p>\n\n Copyright and\/or the photographer’s rights in the submitted or digitally transmitted image remain with the respective participating person.<\/p>\n\n By submitting the exposed photographic paper or transmitting a digital image, the participating person grants The 7th Day a simple, non-exclusive, territorially unrestricted right of use for the duration of the applicable statutory term of protection, insofar as this is necessary for the implementation, documentation, presentation and promotion of the art project The 7th Day.<\/p>\n\n The right of use includes, in particular, the right to:<\/p>\n\n Technical or creative editing must not distort the character of the image.<\/p>\n\n The participating person also permits The 7th Day to grant purchasers of a participation set simple rights of use for non-commercial purposes in archive images specifically approved for such use, in accordance with Section 10.<\/p>\n\n This applies exclusively to images for which The 7th Day holds the rights necessary for such use.<\/p>\n\n By submitting or digitally transmitting an image, the participating person confirms that they are entitled to grant the rights described above.<\/p>\n\n If identifiable persons are depicted in the image or if other third-party rights may be affected, the participating person is responsible for ensuring that the rights or consents required for the intended publication have been obtained.<\/p>\n\n By purchasing a participation set, the purchaser receives a simple, non-exclusive, non-transferable and non-sublicensable right to use archive images that have been specifically approved by The 7th Day for non-commercial purposes.<\/p>\n\n Such approval may result, in particular, from a corresponding designation in the archive, the respective archive access or a separate communication from The 7th Day.<\/p>\n\n The right of use includes, in particular, the use of approved images for private and other non-commercial publications, for example on private websites, private social media channels, in non-commercial presentations or in comparable contexts.<\/p>\n\n Whenever an image is published, the following information must be provided where it is stated in the archive:<\/p>\n\n the photographer or author, the image number and the project name \u201cThe 7th Day\u201d<\/strong><\/p>\n\n Customary technical adjustments that are necessary for the respective publication are permitted, for example resizing, format changes or technically necessary cropping, provided that the character of the work is not distorted.<\/p>\n\n Archive images may not be presented as the user’s own works.<\/p>\n\n The rights granted do not include, in particular, commercial use, the sale of reproductions, use for advertising purposes, licensing to third parties or the granting of further rights of use.<\/p>\n\n Any further or commercial use requires the prior approval of the respective rights holder or The 7th Day, provided that The 7th Day is entitled to grant such approval.<\/p>\n\n The right of use applies exclusively to archive images that have been expressly approved by The 7th Day for such use. Access to the archive therefore does not grant any right of use to the entire archive<\/strong>.<\/p>\n\n The photographer or author of an image they submitted themselves remains fully entitled to use their own image, including for commercial purposes.<\/p>\n\n When publishing their own image, The 7th Day appreciates the inclusion of the project name and image number.<\/p>\n\n Where a product includes access to the digital archive, such access will be provided in accordance with the respective product description.<\/p>\n\n There is no entitlement to the permanent availability of every individual image in the archive.
