These General Terms and Conditions apply to orders placed through The 7th Day online shop.<\/p>\n\n\n\n

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.<\/p>\n\n\n\n
The provisions relating to participation in the art project, submission of photographic paper and rights of use also apply to persons who did not purchase the participation kit themselves but submit exposed photographic paper to The 7th Day. This requires that the person submitting the paper was informed of these participation terms before submission and had a reasonable opportunity to read them.<\/p>\n\n\n\n
The presentation of products in the online shop does not constitute a binding offer to enter into a purchase contract.<\/p>\n\n\n\n
By submitting an order, the customer makes a binding offer to purchase the goods contained in the shopping cart.<\/p>\n\n\n\n
After the order has been received, the customer receives an automatic confirmation that the order has been received. This automatic acknowledgement does not constitute acceptance of the customer’s offer.<\/p>\n\n\n\n
The purchase contract is formed only when The 7th Day expressly accepts the order by sending a separate order confirmation by email.<\/p>\n\n\n\n
An authorisation, reservation or charge made by a payment service provider does not in itself constitute acceptance of the order by The 7th Day. If an order is not accepted, any payments already received will be refunded.<\/p>\n\n\n\n
Customers may initially place the desired products in the shopping cart without obligation. Before submitting the order, the selected products and the information entered can be reviewed and corrected.<\/p>\n\n\n\n
Order data is stored in accordance with statutory retention obligations.<\/p>\n\n\n\n
After the contract has been concluded, the relevant contractual information will be provided to the customer on a durable medium, generally by email.<\/p>\n\n\n\n
The contract language depends on the language version of the shop selected by the customer. The shop is currently offered in German and English.<\/p>\n\n\n\n
The prices displayed in the online shop are final prices.<\/p>\n\n\n\n
No VAT is shown in accordance with Section 19 of the German Value Added Tax Act (UStG).<\/p>\n\n\n\n
Shipping costs may be charged in addition. The applicable shipping costs are displayed before the order is submitted and can also be found on the payment and shipping information page.<\/p>\n\n\n\n
The available payment methods are displayed during the checkout process.<\/p>\n\n\n\n
For deliveries to countries outside the European Union, additional customs duties, taxes or import charges may apply. These charges are not collected by The 7th Day and, where applicable, must be paid by the recipient to the relevant authorities.<\/p>\n\n\n\n
Delivery is made to the delivery address provided by the customer.<\/p>\n\n\n\n
Available delivery areas, shipping methods, shipping costs and estimated delivery times are stated in the online shop or displayed before the order is submitted.<\/p>\n\n\n\n
The shipping costs applicable to the individual order are shown before the customer places the order.<\/p>\n\n\n\n
The goods remain the property of The 7th Day or the provider until full payment has been received.<\/p>\n\n\n\n
The statutory rights relating to defective or non-conforming goods apply.<\/p>\n\n\n\n
The pinhole camera is an experimental photographic process. The specific photographic result depends in particular on exposure time, lighting conditions, location, weather, orientation, placement and handling of the camera.<\/p>\n\n\n\n
No particular photographic, colour or artistic result is therefore guaranteed. The absence of a particular image result does not in itself constitute a defect in the camera or participation kit, provided that the supplied components have the agreed characteristics.<\/p>\n\n\n\n
The customer’s statutory rights in the event of actually defective goods remain unaffected.<\/p>\n\n\n\n
Purchasing a participation kit does not require the customer to return the exposed photographic paper to The 7th Day.<\/p>\n\n\n\n
Submitting the exposed photographic paper is voluntary. Anyone who does not submit the photographic paper does not participate in the digital project archive with that image.<\/p>\n\n\n\n
By voluntarily submitting the exposed photographic paper, the person submitting it chooses to participate in The 7th Day art project in accordance with these participation terms.<\/p>\n\n\n\n
If the person submitting the image is a minor, any consent required from a parent or legal guardian for participation and the granting of rights must be obtained.<\/p>\n\n\n\n
When the exposed photographic paper is submitted, the resulting image is digitised by The 7th Day and technically processed for presentation within the project.<\/p>\n\n\n\n
Technical processing may include, in particular, scanning, conversion from negative to positive, orientation and customary adjustments to brightness, contrast and colour.<\/p>\n\n\n\n
The digitised image is subsequently published in The 7th Day’s publicly accessible online archive. By submitting the photographic paper, the participant agrees to this publication in accordance with the licensing provisions below.<\/p>\n\n\n\n
No additional approval is required after submission. Anyone who does not want their image to be published in the digital archive should not submit the exposed photographic paper to The 7th Day.<\/p>\n\n\n\n
The 7th Day reserves the right not to publish individual images, or to remove them from the archive, for legal, technical or content-related reasons.<\/p>\n\n\n\n
During scanning, the light-sensitive photographic paper is fully exposed to light. As a result, the original analogue negative is destroyed or rendered unusable as the original negative and cannot be returned in its original condition. By submitting the photographic paper, the participant agrees to this technically necessary process.<\/p>\n\n\n\n
Copyright and any related rights in the submitted image remain with the respective participant.<\/p>\n\n\n\n
By submitting an image, the participant grants The 7th Day a non-exclusive, worldwide right of use for the duration of the applicable statutory protection period, insofar as this is necessary for the operation, documentation, presentation and promotion of The 7th Day art project.<\/p>\n\n\n\n
This right includes, in particular, the right to digitise, reproduce and technically process the image, make it publicly available in the online archive and use it in connection with The 7th Day on websites, social media, in exhibitions, presentations, press activities, editorial coverage and publications about the project.<\/p>\n\n\n\n
Technical processing must not distort the character of the image.<\/p>\n\n\n\n
The participant expressly authorises The 7th Day to grant purchasers of a participation kit non-exclusive rights to use archive images cleared for such use for non-commercial purposes. This applies only to images for which The 7th Day holds the rights required to grant such use.<\/p>\n\n\n\n
By submitting an image, the participant confirms that they are entitled to grant the rights described above.<\/p>\n\n\n\n
If identifiable persons appear in a submitted image or other third-party rights may be affected, the participant is responsible for ensuring that any rights or consents required for the intended publication are in place.<\/p>\n\n\n\n
By purchasing a participation kit, the purchaser receives a non-exclusive licence to use the archive images cleared for such use for non-commercial purposes.<\/p>\n\n\n\n
This licence permits the use of cleared archive images in particular for private and other non-commercial publications.<\/p>\n\n\n\n
Whenever an image is published, the author identified in the archive, where available, must be credited together with the image number and the project name \u201cThe 7th Day\u201d.<\/p>\n\n\n\n
Archive images may not be presented as the user’s own works. The licence is non-transferable and does not permit the user to grant further rights of use to third parties.<\/p>\n\n\n\n
Commercial use of archive images is permitted only with the prior approval of the relevant rights holder or The 7th Day, where The 7th Day is authorised to grant such approval.<\/p>\n\n\n\n
The licence applies only to archive images that have been cleared for this type of use.<\/p>\n\n\n\n
The author of their own submitted image remains free to use that image themselves, including for commercial purposes. When publishing their own image, The 7th Day asks that the project name and image number be credited.<\/p>\n\n\n\n
Where a product includes access to the digital archive, access is provided in accordance with the respective product description.<\/p>\n\n\n\n
There is no entitlement to permanent availability of a particular image in the archive where removal is required for legal, technical or content-related reasons.<\/p>\n\n\n\n
Consumers have a statutory right of withdrawal where the legal requirements are met.<\/p>\n\n\n\n
Details concerning the conditions, deadlines and consequences of withdrawal are set out in The 7th Day’s separate cancellation policy.<\/p>\n\n\n\n
Where required by law, consumers are also provided with an electronic withdrawal function on the website.<\/p>\n\n\n\n

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).<\/p>\n\n\n\n
